Creator Agreement
Revenue
8.1 Your Revenue Share
You receive the Revenue Share — a percentage of net revenue attributable to your Content. Flower Puss retains the remainder. The Revenue Share is applied to net revenue as defined below, not to the price a Member pays.
✔ Where the current rate is published
The Revenue Share that applies to you, together with the Holding Periods in section 9, the payout schedule in section 10 and the low-value write-off threshold in section 11, are published in the Rate Schedule in your Creator account. That is the authoritative record of the rates in force at any time.
8.2 Changes to the rates
We may change the published rates. Where a change would reduce your Revenue Share, lengthen a Holding Period, or make the payout schedule less frequent, we will give you at least 30 days’ written notice before it takes effect, and it will apply only to earnings recorded after that date. Earnings already recorded are settled at the rate that applied when they were recorded. If you do not accept a change, you may stop supplying Content and close your account under section 14.
8.3 How net revenue is calculated
Net revenue for a transaction is the gross transaction value attributable to your Content, less each of the following:
| Deduction | What it is |
|---|---|
| Applicable GST | Goods and services tax we account for as principal on the transaction, at 1/11 of the full transaction value where GST applies. |
| Processing costs | The costs of taking and settling the payment, including provider and network costs incurred in accepting the Member’s funds. |
| Refunds and credits | Any refund or credit granted to a Member for that transaction under our Refund & Cancellation Policy or the Australian Consumer Law. |
Your Revenue Share is calculated on the amount that remains. All amounts are calculated and recorded in Australian dollars.
Why two identical sales can pay you differently. Prices include GST, and GST is only payable on sales to Members in a location where Australian GST applies. On a sale where it applies, GST comes out of the price before your share is calculated. On a sale where it does not, there is nothing to take out — so the same headline price leaves more to share. Nothing about your Revenue Share has changed; there is simply less tax to deduct first.
8.4 What the Revenue Share does not cover
The Revenue Share applies to net revenue attributable to your Content — Member subscriptions to you, pay-per-view unlocks of your Content, and tips sent to you.
It does not apply to Community Membership. A Community Membership is a Member’s access to the Flower Puss platform itself, sold by Flower Puss and not attributable to any Creator. Flower Puss retains 100% of net Community Membership revenue. A Member holding a Community Membership may still subscribe to you, unlock your Content or tip you, and those transactions carry your Revenue Share in the normal way.
Where we introduce a new revenue line, we will tell you before it goes live whether it is shared and on what basis. We will not apply a Revenue Share lower than the published rate without notice under section 8.2.
8.5 Refunds and credits on our platform
The first remedy for a Member is to put their access right; where that is not adequate, or where the Australian Consumer Law requires it, we make a refund. Either reduces net revenue for the affected transaction. Where a credit or refund lands after your share has already been released, section 11 applies.
8.6 When a Member buys several months at once
You set one monthly subscription price in your profile. A Member can buy however many months they want at that price and pay for all of them up front. When they do, your share is earned month by month, as the access is actually delivered. It is not paid to you in a single amount on the day of the sale.
So a Member who buys twelve months shows in your account as twelve monthly earnings, not one large one. That is deliberate, and it works in your favour: if the Member is refunded part-way through, you keep every month you have already earned, and the remaining months simply never accrue. There is nothing to claw back from you and no negative balance to clear.
Each monthly earning then passes through the holding period in section 9 in the normal way.
If you change your monthly price, the new price applies to Months bought after the change. Months a Member has already paid for stay at the price that applied when they bought them, and you are paid at that price for each of them.
If you leave while Members still have months paid for. You keep everything you earned for months you actually delivered — we do not claw any of it back. The months a Member has paid for but not yet received are refunded to them by Flower Puss, at our cost, out of our share. You are not charged for them.
8.7 Reporting
Your earnings are shown in your Creator account, split into pending and available balances, with the transaction each earning relates to. If you think a figure is wrong, contact billing@flowerpuss.global. We acknowledge billing enquiries within 2 business days and aim to resolve them within 10.
9. Holding Periods
Earnings do not become withdrawable the moment they are recorded. Every earning passes through a holding period first.
| Situation | Which period applies |
|---|---|
| Standard | The Standard Holding Period, running from the date the earning is recorded to your account. |
| New accounts | The Extended Holding Period, for an initial period after your Creator account is verified. |
| Risk flag or recent dispute | The Extended Holding Period, where a risk flag is active on your account, or where there has been a recent dispute or refund pattern. |
The current length of each period, and the length of the initial period for new accounts, are published in the Rate Schedule in your Creator account. Section 8.2 applies if we lengthen them.
9.1 Pending funds are visible, not withdrawable
During the holding period the earning appears in your pending balance. You can see it. You cannot withdraw it, and it is not included in a payout batch. When the holding period ends the earning moves to your available balance.
9.2 We set and enforce the hold
The holding period is set and enforced by Flower Puss. It is not imposed by a payment provider, and we do not describe it as one. It exists so that refunds, credits, safety reviews and verification checks can be resolved before money leaves the platform.
9.3 Extending a hold
We may extend a holding period, or hold a specific earning beyond it, where the related Content is under review, where verification or consent records have been requested and not produced, where a safety report or investigation is open, or where we reasonably suspect fraud or a breach of this Agreement. We will tell you when we do this and why, unless the law prevents us from doing so.
10. Payouts
10.1 Payouts run in batches
Payouts are scheduled and batched, not on demand. We run payout batches on the schedule published in your Creator account. Your available balance at the batch cut-off is included in that batch. Anything still pending waits for the next one. We will publish the batch dates in your Creator account and give you notice if the schedule changes.
10.2 We may review or delay a payout
Before a payout executes we may review it, and we may delay it. We do this where a verification, safety, fraud or compliance check is outstanding, where your details do not match your verification records, where a sanctions or screening match needs to be cleared, or where a refund or credit is likely to change your balance. A delayed payout is released into a later batch once the matter is resolved.
10.3 You bear the network fee
Payouts settle on-chain. The on-chain network fee for your payout is borne by you and is deducted from the amount paid. Network fees vary with network conditions and we do not control them.
10.4 Currency and payout routes
- Your balance is recorded and calculated in Australian dollars. Where a payout settles in another unit, the conversion applied at the time of the batch is shown on your payout record.
- Payout routes vary by country. Non-Australian Creators may have fewer routes available, and in some countries we may not be able to offer a route at all. We will tell you what is available to you before you rely on it.
- You must give us payout details that match your verified identity. We do not pay to a third party, and we do not pay to an account or address held in someone else’s name.
10.5 Failed payouts
If a payout fails because the details you gave us were wrong, incomplete or no longer valid, the funds return to your available balance where they can be recovered, and any cost of the failed attempt is deducted from your balance. Funds sent to an address you gave us incorrectly cannot be recovered by us.
11. Refunds, Credits & Negative Balances
11.1 Adjustments after release
A refund or credit can be granted after your share of a transaction has already been released or paid — for example where a Member reports a problem later, or where an investigation finds that a transaction should not have completed. When that happens we reverse your share of that transaction. This is a normal accounting adjustment, not a penalty.
11.2 Set-off against future earnings
We may set off any amount you owe us under this Agreement against any amount we owe you. If a reversal is larger than your current balance, your balance goes negative, and the shortfall is recovered from your future earnings until it is cleared. A negative balance does not stop you supplying Content, but no payout runs while it stands.
11.3 Write-off threshold
We do not chase small amounts. Where a negative balance remains after your account has been closed, and the amount is below our low-value write-off threshold, we write it off and take no further action to recover it.
11.4 Other recovery
Where a balance is negative because of confirmed fraud, deliberate misuse of the Services, or supply of prohibited Content, the write-off in section 11.3 does not apply and we may recover the amount as a debt.
11.5 A note on payment reversals
At launch, payment to Flower Puss is made in cryptocurrency and is irreversible. There is no chargeback and no reversal to an original payment method, so adjustments to your balance come from refunds and credits we grant, not from a card dispute. Where a card payment method is in operation, the equivalent card-scheme reversal will be treated the same way as a refund under this section.
12. Cooperation Obligations
Timely cooperation is a condition of your access to the Services, not a courtesy. You must:
- respond to compliance, verification, safety, fraud and law-enforcement requests within the timeframe we specify, and in any event within 5 business days unless a shorter period is required;
- produce documentary proof of age and consent, including signed model releases, for every identifiable participant in your Content, on request;
- preserve relevant records, and not destroy, alter or conceal material that is the subject of an investigation or dispute;
- promptly action takedown, edit, demonetisation or re-verification directions issued by our Trust, Safety & Compliance function;
- cooperate in good faith with internal investigations and with any regulatory or law-enforcement matter; and
- authorise us to share the Creator and transaction information necessary to resolve a dispute, meet a legal obligation, or respond to a lawful request from a regulator or law-enforcement agency.
Failure to cooperate is itself a breach, independent of whatever prompted the request. It can trigger an extended hold under section 9.3, a delayed payout under section 10.2, and account action under section 14.
13. Warranties & Indemnity
13.1 What you warrant
You warrant, each time you supply Content and on a continuing basis, that:
- you are 18 or older, and you are not a resident or citizen of the European Union, the United Kingdom or the United States of America;
- you own your Content, or hold every licence, right, consent and release needed to supply it to us and for us to sell it under section 7;
- every identifiable participant in your Content is a verified adult who has given explicit, documented and informed consent, and you hold the records to prove it;
- your Content contains nothing prohibited under section 6;
- your Content and your conduct comply with this Agreement, our other policies, and all applicable laws; and
- the identity, age, residence, citizenship, tax and payout information you have given us is true, complete and current.
13.2 Indemnity
You indemnify Flower Puss against any loss, damage, cost, fine, penalty or expense — including reasonable legal costs — that we suffer arising out of your breach of this Agreement, your breach of a warranty in section 13.1, a claim by a third party about your Content, or your failure to cooperate under section 12. We will tell you promptly about any claim we intend to rely on this section for, and will not settle it without first giving you a reasonable opportunity to respond.
13.3 Our liability
Nothing in this Agreement excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, we are not liable to you for loss of profit, loss of opportunity, or indirect or consequential loss arising out of this Agreement.
14. Suspension, Termination & Pending Balances
14.1 You may leave
You may close your Creator account at any time by telling us at support@flowerpuss.global. Closing your account stops new supply and new sales. It does not by itself end access a Member has already bought for the period that access covers.
14.2 When we may suspend or terminate
We may suspend your account, demonetise or remove Content, or terminate this Agreement where you breach this Agreement or our other policies, where you supply prohibited Content, where verification fails or is not completed, where you are found to be a resident or citizen of an excluded country, where you do not cooperate under section 12, or where we reasonably suspect fraud or unlawful activity. Serious or unlawful conduct results in immediate termination without notice. Everything else follows the enforcement ladder in our Acceptable Use Policy, and you may appeal a decision to our Trust, Safety & Compliance function.
14.3 What happens to your balance
Termination does not cancel what we owe you for compliant Content already sold. On termination:
- your pending balance stays pending until the applicable holding period under section 9 has run;
- we apply any set-off under section 11 — reversals, refunds, credits and amounts you owe us — to the balance;
- whatever remains is paid to you in the next scheduled payout batch after the holding period ends, using your verified payout details, with the network fee borne by you;
- we may withhold an amount, and hold it beyond the normal period, while an investigation, a safety report, an unresolved refund exposure or a lawful request is open. We release it once the matter is resolved, or apply it under section 11 if the outcome requires that; and
- earnings attributable to prohibited Content, to confirmed fraud, or to Content whose age and consent records cannot be produced, are forfeited and are not paid.
If your balance is negative on termination, section 11.2 and section 11.3 apply.
14.4 What survives
Sections 6, 7.2 (to the extent stated), 11, 12, 13, 14.3 and 15 survive termination, along with any record-keeping obligation. We retain verification, consent, moderation and financial records for the periods required by law — financial records for 7 years under section 286 of the Corporations Act 2001 (Cth).
15. Governance & Contact
This Agreement is governed by the laws of New South Wales, Australia, and you and Flower Puss submit to the non-exclusive jurisdiction of the courts of that State. It is read together with the other documents in our Legal Centre. We review it at least annually and whenever there is a material change in the law or in how the Services operate. We will notify you of material changes before they take effect, and continuing to supply Content after that means you accept them.
Payment providers and payment methods are published as each is confirmed and integrated. We do not name a provider in this Agreement.
We acknowledge billing and payout disputes within 2 business days and aim to resolve them within 10. Compliance enquiries are answered within 7 business days. Urgent safety reports are actioned without delay and prioritised immediately.
