Refund & Cancellation Policy

This Refund & Cancellation Policy governs how you pay for the Services, how subscriptions renew and end, and what happens when you want your money back. It is issued by Flower Puss Pty Ltd (ABN 93 684 368 401) (“Flower Puss”, “we”, “us”, “our”). Flower Puss is the merchant and seller of record on every transaction: your contract is with us, not with a Creator. Nothing in this Policy limits your rights under the Australian Consumer Law.

1. Purpose & Scope

This Policy applies to every payment made to Flower Puss by a Member, and to every refund, credit or adjustment arising from one. Read it together with our Terms of Service, Acceptable Use Policy, Privacy Policy and Creator Agreement.

1.1 What it covers

  • paying for a Community Membership or a Creator subscription;
  • one-off purchases — content unlocks, tips, commissioned Content and bookings; and
  • remedies, refunds and the disputes that follow them.

1.2 Who can transact

You must be 18 or older. Age assurance must be completed before you can reach any payment area, and no purchase completes without it. We do not offer the Services to residents or citizens of the European Union, the United Kingdom or the United States of America — a restriction on where we offer the Services, arising from our payment arrangements, and enforced by us at signup on both country and citizenship. If an account is found to be held in breach of that restriction we will close it and contact the account holder about any remaining balance.

1.3 Who you are buying from

Creators supply Content to Flower Puss. They are not sellers, not merchants, and not parties to your transaction. A Creator never holds a merchant account and never appears on any statement of yours. Every refund, credit and dispute is handled by Flower Puss.

2. Definitions

MemberAn adult, age-assured account holder who funds a balance and buys Content or Services.
CreatorA verified adult who supplies Content to Flower Puss for publication on the Services.
ContentAny image, video, audio, livestream, text or digital asset published on the Services.
ServicesThe Flower Puss websites, applications and related services.
Payment requestThe request we generate for a single purchase, showing the Australian dollar price, the cryptocurrency amount, the network and the address to send to.
Access remedyPutting a purchase right by restoring, extending or re-granting the access you bought.
On-chain refundA transfer of cryptocurrency out of the platform to a wallet address. Exceptional, and at our discretion.

3. How You Pay

You pay for each purchase individually, at the time you make it. There is no balance to fund first and nothing to spend down.

  1. You complete age assurance.
  2. You choose what you want to buy. We show you the price in Australian dollars and generate a payment request for that purchase, showing the cryptocurrency amount, the network and the address to send to.
  3. You send the accepted cryptocurrency to the details shown.
  4. When the transfer is confirmed, the purchase completes and your access is activated. The transaction is recorded in your history in Australian dollars.

3.1 What this means for you

  • Prices are set and recorded in Australian dollars. The cryptocurrency amount is worked out at the rate quoted on the payment request. Later movements in the price of any cryptocurrency do not change what you paid or what you received.
  • We do not hold money for you between purchases. Each payment buys one thing, and it is complete once your access is on.
  • Every purchase is itemised in your account history.

4. Accepted Assets — USDT and USDC Only

We accept USDT and USDC only. Your payment request shows the asset and the network to use, and the address to send to. Send exactly what those instructions say.

⚠ Anything else is not accepted and cannot be recovered

A transfer of any other asset, or a transfer that does not match the deposit instructions shown to you, is not accepted and not recoverable. It will not be credited to your balance, we cannot return it, and no remedy under this Policy applies to it. This is a property of the blockchain, not a policy choice: once a transfer is confirmed, we cannot undo it or redirect it. Please check the asset, the network and the address before you send.

Nothing else is a payment method at launch. Where a payment method or provider is later confirmed and integrated, it will be published in the Legal Centre in accordance with the standing notice there. We do not name payment providers on this page.

5. Payments Are Irreversible

This is the most important thing on this page. Payment in cryptocurrency cannot be reversed by anyone — not by you, not by us, and not by any third party.

  • There is no chargeback and no dispute right against an issuing bank, because there is no card and no issuing bank in the transaction.
  • There is no reversal to the original payment method. A completed transfer cannot be pulled back.
  • A mistaken transfer — wrong address, wrong asset, wrong network, wrong amount — cannot be undone by us.
  • Because there is no external reversal route, our internal process in Sections 12 to 14 is the way a Member gets a remedy. We have written it to do that job properly.

This does not reduce your consumer rights

The absence of a chargeback route does not remove or limit any right you have under the Australian Consumer Law. Those rights are set out in Section 9 and cannot be excluded by this Policy or by the way you paid.

6. Pricing, GST & Currency

  • Currency. All prices are displayed and charged in Australian dollars.
  • GST. Flower Puss sells as principal and books GST at 1/11 of the full transaction value. Prices shown include Australian GST where it applies.
  • Disclosure before you buy. The price, what you get, and — for a membership or subscription — how long the period runs and the date it ends are shown before you confirm. A receipt is available in your account.
  • Price changes. A new price applies only to periods you buy after the change. A period you have already paid for is unaffected.
  • Costs outside our control. Network fees charged by a blockchain, and any fee charged by a wallet or exchange you use, are not charged by us and are not refundable by us.

7. When a Subscription or Membership Period Ends

A Community Membership and a Creator subscription each run for a fixed period that you buy up front. They do not renew automatically. There is no stored card, no credential on file and no balance to draw on, so nothing is ever charged without you choosing to buy it.

  1. Your access runs for the whole period you paid for.
  2. We notify you before the period ends, so you can decide whether to buy another one.
  3. At the end of the period, access to the paid tier stops. Nothing is charged, nothing is retried, no fee applies and you owe nothing.
  4. You can buy another period at any time, at the price then published. We do not backdate a period that has lapsed.
What happens When Effect on you
You buy a period At purchase Access activates once the payment is confirmed; itemised in your history
Reminder notice Before the period ends You choose whether to buy another period
Period ends End date shown at purchase Access to the paid tier stops; no charge, no retry, no fee, no debt
You buy again Whenever you choose A new period starts at the price then published

8. Cancellation

You can cancel a subscription at any time in your account settings. Your access continues until the end of the period you have already paid for, and nothing further is charged. Cancelling does not by itself produce a refund of the current period, except where Section 9 or Section 10 gives you one.

You can also close your account at any time. If you close an account that still holds a balance, contact billing@flowerpuss.global before you do, so we can deal with the remaining amount with you.

9. Your Rights Under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Paying in cryptocurrency does not change that. Nothing in this Policy — including Section 5, Section 11 or anything labelled non-refundable — limits, excludes or modifies a guarantee, right or remedy that the law says cannot be excluded.

  • Content and Services you buy must be of acceptable quality, fit for the purpose we describe, and match their description.
  • For a major failure, you are entitled to cancel and get a refund, or to keep what you bought and seek compensation for the drop in value. Where the law gives you that choice, the choice is yours, not ours.
  • For a failure that is not major, we will fix the problem within a reasonable time. If we do not, you may cancel and obtain a refund.
  • You may also be entitled to compensation for reasonably foreseeable loss or damage.

A service remedy is our first step, not your ceiling

Section 12 makes putting your access right our first step, because on this rail it is the fastest way to fix the problem. Where the Australian Consumer Law entitles you to a refund of money, you can insist on a refund instead, and we will pay it. We will agree the method with you, because there is no original payment method to reverse to.

10. Refund Eligibility

Digital Content is delivered and consumed immediately, so purchases are generally final. Beyond your rights in Section 9, we will also put things right in the situations below. Time is counted from the date of the transaction.

Situation Window Outcome
Duplicate or double debit of your balance 60 days The duplicate is credited back in full
Top-up not credited, or credited at the wrong amount 60 days Ledger corrected once the transfer is confirmed on-chain
Content paid for but not delivered 30 days Delivery, or full credit
Content materially not as described, or faulty 14 days Replacement, or credit — and a refund where Section 9 requires it
Subscription debited after a valid cancellation 1 cycle The wrongly debited cycle is credited back
Unauthorised use of your account Report without delay Account secured, transactions investigated, verified losses restored

Report unauthorised access as soon as you notice it. We will lock the account, review the transactions, and restore the value of anything we confirm you did not authorise.

11. What Is Not Refundable

Subject always to Section 9 and Section 10, the following are sold on a non-refundable basis. This is disclosed to you before you confirm the purchase:

  • tips and other voluntary payments to a Creator;
  • content unlocks that have been viewed or downloaded;
  • commissioned Content delivered to the agreed specification and timeframe;
  • the unused remainder of a subscription period after a mid-period cancellation; and
  • any transfer of an asset we do not accept, or a transfer that did not follow the deposit instructions shown to you — see Section 4.

A change of mind is not a fault. We are not required to give a refund or a credit because you changed your mind, decided you did not want it, or bought the wrong thing — although we will always look at the circumstances.

12. How a Remedy Is Paid

12.1 First, we put your access right

Where a remedy is due, our first step is to fix the access you bought — by restoring it, extending it for the time you lost, or granting it again. It is immediate, it costs you nothing, and on a rail where payments cannot be reversed it is usually the most useful outcome. We will tell you what we are doing and why.

12.2 On-chain refunds

Where putting your access right is not an adequate remedy, or where the Australian Consumer Law entitles you to money rather than a repair, we make an on-chain refund — sending cryptocurrency back to a wallet. Outside those cases an on-chain refund is at our discretion. Where we do make one:

  • we send to the wallet address the original payment came from, unless we agree otherwise with you in writing;
  • we send USDT or USDC in an amount equal to the Australian dollar sum being refunded, converted at the time we make the transfer;
  • a network fee applies to the transfer, and we tell you the amount that will arrive before we send it; and
  • we may ask you to confirm control of the receiving wallet first, and we may decline to send to an address that fails a compliance check.

We do not send on-chain refunds to a third party’s wallet, and we do not use a refund request as a way to move funds off the platform.

12.3 Effect on the Creator

A refund or credit is applied against the Creator’s earnings for the affected transaction. Where the earnings have already been released, the shortfall is recovered from the Creator’s future earnings, and below a minimum recovery threshold it is written off rather than pursued. The full terms are in the Creator Agreement. None of this affects the remedy you receive, or when you receive it.

13. Asking for a Remedy

  • How. Email billing@flowerpuss.global, or raise it from the transaction in your account history. Tell us the transaction reference, the date, and what went wrong. For a payment problem, include the on-chain transaction reference.
  • Acknowledgement. We acknowledge your request within 2 business days.
  • Decision. We resolve it within 10 business days. If we need longer — for example, while a transfer confirms on-chain — we tell you why and when to expect an answer.
  • Outcome. A credit appears in your balance as soon as it is approved. An on-chain refund is sent after the checks in Section 12.2.
  • Reasons. If we decline, we tell you why and how to escalate under Section 14.

14. Disputes & Escalation

Come to us first. Because payment is made in cryptocurrency, there is no issuing bank to dispute with and no chargeback to raise, so our internal process is the practical route to a remedy — and it is faster than an external one.

14.1 Tier 1 — internal resolution

Raise the dispute at billing@flowerpuss.global or from your account. We acknowledge within 2 business days and aim to resolve within 10 business days, applying this Policy and the Australian Consumer Law.

14.2 Tier 2 — internal review

If you are not satisfied with the Tier 1 outcome, ask for a review. The review is carried out by someone who was not involved in the original decision. We give you a written outcome with reasons, normally within a further 10 business days. This is the end of our internal process.

14.3 Tier 3 — external escalation

If you are still not satisfied, you can take the matter outside Flower Puss. In Australia you can contact the consumer protection or fair trading agency in your state or territory, or the Australian Competition and Consumer Commission, and you may be able to bring the matter to the civil and administrative tribunal in your state or territory. Outside Australia, you can contact the consumer protection agency in your own jurisdiction. Nothing in this Policy removes any of those rights.

14.4 Misuse of the remedy process

Repeated requests to reverse Content that was delivered as described, or requests made to move value rather than to fix a problem, are reviewed under our Acceptable Use Policy and may lead to account action. That review never affects a request that is genuine, and never affects your rights under Section 9.

15. Future Payment Methods

Cryptocurrency is the only payment method in operation. We are not describing anything else as live, and we do not name a provider until it is confirmed and integrated. Methods and providers are published in the Legal Centre as each is confirmed.

Where a card payment method is in operation in the future, the terms specific to it — including how a refund is returned to the card, the descriptor shown on your statement, and how a dispute raised with your card issuer is handled — will be published in an updated version of this Policy before that method accepts a single payment. Until then, no clause of this Policy should be read as describing a card, an issuing bank, a chargeback, a representment or a settlement arrangement that exists today.

16. Governance, Governing Law & Contact

This Policy is governed by the laws of New South Wales, Australia, and is read together with our Terms of Service, Privacy Policy, Acceptable Use Policy and Creator Agreement. Where a term of this Policy conflicts with a consumer right that cannot be excluded, that right prevails to the extent of the inconsistency.

We review this Policy at least annually, and whenever the payment architecture or the applicable law changes materially. Each version carries its own version number, effective date and last-updated date. Continued use of the Services after an updated Policy takes effect means you accept the changes; changes never apply retrospectively to a purchase already made.
