Term and condition
These Terms of Service (the “Terms”) are a binding agreement between you and Flower Puss Pty Ltd (ABN 93 684 368 401 · ACN 684 368 401) (“Flower Puss”, “we”, “us” or “our”). They are the master agreement for the Services. Read them alongside our Privacy Policy, Acceptable Use Policy, Content & Community Guidelines, Refund & Cancellation Policy, Age Verification & Restricted Content Policy, Cookie Policy and, if you publish on the Services, the Creator Agreement. Those documents form part of these Terms. If a policy conflicts with these Terms, these Terms prevail unless that policy says otherwise.
1. Who We Are
Flower Puss Pty Ltd is an Australian company. Our registered office is C/- Whitehawk Advisors Pty Limited, Floor 11, 65 York Street, Sydney NSW 2000, Australia.
Flower Puss Pty Ltd is the only company you contract with. It is the company that sells to you, takes your money, and answers to you if something goes wrong. No other company is a party to these Terms.
Flower Puss is an adult lifestyle and creator-economy platform, delivered as a Progressive Web App and related online services. Verified adult Creators publish Content. Verified adult Members buy access to it through subscriptions, pay-per-view purchases, tips, custom requests and similar arrangements.
By accessing, browsing, registering for, uploading to or transacting on the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Definitions
“Member”, “Creator”, “Content”, “Services” and “Purchase” have the meanings above wherever they appear capitalised in these Terms.
3. Eligibility & Where We Offer the Services
3.1 You must be 18 or older
You must be 18 years of age or older to use the Services. This applies to Members and Creators alike. There are no exceptions and no variation by country. You must also be legally able to enter into a binding contract.
3.2 Countries where we do not offer the Services
We do not offer the Services to people connected with the European Union, the United Kingdom or the United States of America. You cannot register or use the Services if you are:
- resident in a member state of the European Union, the United Kingdom, or the United States of America (including its territories); or
- a citizen of a member state of the European Union, the United Kingdom, or the United States of America.
This restriction applies to Members and Creators alike. We ask for your country of residence and your citizenship at signup, and we block registration where either falls in a restricted country. If we later find that you are resident in or a citizen of a restricted country, we will close your account.
Why this restriction exists
This is a decision about where we offer the Services. It follows from our payment arrangements, and it is ours to enforce — not a payment provider’s, and not yours. It is not a statement about whether adult Content is lawful in the European Union, the United Kingdom or the United States, and you should not read it as one.
3.3 Everywhere else
If you are outside those countries, you are still responsible for making sure your use of the Services is lawful where you are. We may decline or withdraw access to any country at any time.
4. Verification
There are two separate checks. They are not the same check, they collect different things, and passing one does not pass the other.
4.1 Member age assurance
- At registration you must confirm you are 18 or older and accept these Terms. That is a gate, not a verification.
- Before you can view restricted Content, subscribe, or reach any payment area of the Services, you must complete age assurance through a specialist third-party provider.
- Age assurance is completed before any purchase completes. You cannot subscribe or buy without it.
- From that check, Flower Puss stores only the result: a verified-18-plus flag, the provider used, the timestamp, the provider’s reference, the country, and your user ID.
We do not keep your ID
Flower Puss does not receive or store your identity documents and does not receive or store facial images from Member age assurance. We hold the outcome and nothing more. Our Privacy Policy sets out how that record is handled.
4.2 Creator identity verification
If you want to publish or be paid, you must complete a fuller process before you can do either. It requires:
- government-issued photographic identification;
- a liveness check;
- proof that you are 18 or older; and
- anti-money-laundering and sanctions screening.
Records from Creator identity verification are retained as compliance evidence and are available for lawful review. We may require you to re-verify at any time, and we may suspend publishing or payouts until you do.
4.3 Providers
Verification is carried out by specialist third-party providers. We publish the identity of a provider once it is confirmed and integrated. Using the Services means you accept that a provider may need to process your information to complete the check.
5. Your Account
- Give us accurate registration information, including your country of residence and citizenship, and keep it current.
- Keep your login credentials secure. You are responsible for activity under your account.
- Do not hold more than one account to get around enforcement, verification or the country restrictions in Section 3.
- Accounts and subscriptions are personal to you. You may not sell, share or transfer them.
- Tell us promptly at support@flowerpuss.global if you think someone else has used your account.
6. The Services & Your Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own lawful, non-commercial enjoyment. If you are a Creator, your licence to publish and monetise is set out in the Creator Agreement.
We may add, change, suspend or withdraw features. Some parts of the Services depend on third-party providers, and those parts may be unavailable from time to time. We will not make a material reduction to a feature you have already paid for without offering you a remedy under Section 12.
7. We Are the Merchant & Seller of Record
Flower Puss is the merchant and seller of record on every transaction on the Services. When you buy a subscription, a piece of Content, or anything else on the Services, you buy it from Flower Puss Pty Ltd. Your contract is with us.
Creators supply Flower Puss. They are not independent sellers, they are not marketplace sellers, and they are not a party to your transaction. A Creator never holds a merchant account, and a Creator’s name never appears as the seller on your payment record.
Because we sell as principal, we account for GST as principal at 1/11 of the full transaction value where GST applies. Your receipt comes from Flower Puss.
What this means for you
If a purchase goes wrong, you deal with us. You do not have to chase a Creator, and we will not send you to one. Section 12 sets out your remedies and Section 18 sets out the consumer guarantees we cannot exclude.
8. How You Pay
8.1 One purchase, one payment
Every purchase on the Services is paid for individually, at the time you make it. You choose what you want, we generate a payment request for that purchase, and access is activated once the payment is confirmed.
There is no stored balance on the Services. You do not pre-load funds and spend them down, and we do not hold money for you between purchases. Each payment is complete in itself.
8.2 What you can buy
- A Community Membership — access to the Flower Puss platform for a period.
- A subscription to a Creator — access to that Creator’s subscriber Content for a period.
- A pay-per-view unlock — one-off access to a specific piece of Content.
- A tip to a Creator.
Each of these is bought as its own payment. Buying one does not give you the others.
8.3 Currency
Prices are set and displayed in Australian dollars, and our ledger records every transaction in Australian dollars. You pay the Australian dollar price in cryptocurrency at the rate quoted to you on the payment request. Later movements in the price of any cryptocurrency do not change what you paid or what you received.
8.4 Before you can pay
- You must complete age assurance under Section 4 before any purchase can complete.
- We may decline a payment request, or hold a purchase for review, where a transaction is flagged under our risk, sanctions or safety checks.
- You may not buy on behalf of another person, or resell or transfer access you have bought.
9. Paying by Cryptocurrency
9.1 The only accepted assets
At launch, the only way to pay is with cryptocurrency, and the only accepted assets are USDT and USDC. You must send the accepted asset on a network we display to you, to the address we display to you, within the window we display to you.
Send anything else and it is gone
We accept USDT and USDC only. If you send any other cryptocurrency, or send an accepted asset on a network we have not asked you to use, or send to an address we did not give you, that payment is not accepted and cannot be recovered. It will not be credited to your purchase, it cannot be returned to you, and we cannot retrieve it. Check the asset, the network and the address every time before you send.
9.2 Confirmation
A payment is complete once the transfer is confirmed on the relevant network and has passed our checks, and your access is activated at that point. Confirmation is not instant and timing is outside our control. Network fees charged by the network or by your wallet are yours to pay and are not part of the amount credited.
9.3 Irreversibility
Cryptocurrency payments are irreversible. Once a transfer is confirmed on-chain it cannot be undone, by you or by us. There is no chargeback, no representment, no issuing bank and no reversal to the original payment method. Section 12 sets out what we do instead.
9.4 Your responsibility
- You are responsible for the wallet you send from and for the accuracy of every detail you enter.
- Send only assets you own and are lawfully entitled to send.
- We monitor transactions, and we may decline a payment request, reverse an access activation, suspend an account or terminate it, and cooperate with law enforcement and regulators, where we are required to by law or where we reasonably suspect fraud, sanctions exposure or money laundering.
- We do not give financial, tax or investment advice. Any tax consequence of your cryptocurrency dealings is yours.
9.5 Other payment methods
Cryptocurrency is the only payment method in operation. Where another payment method is introduced, we will publish the terms that apply to it before it goes live. Payment providers and methods are published on the Legal Centre once each is confirmed and integrated.
10. Prices, Purchases & Subscriptions
- Prices are displayed and charged in Australian dollars, inclusive of GST where GST applies.
- Each purchase is paid for on its own, at the time you make it.
- Before you buy, we show you the price, what you get, and — for a membership or subscription — how long the period runs and the date it ends.
- A one-off purchase gives you access to that Content on the terms shown at the time of sale.
- A subscription gives you access for the billing period shown, and renews under Section 11 until you cancel.
- You may cancel a subscription at any time in your account settings. Cancelling stops the next renewal. Your access continues to the end of the period you have already paid for.
- Content available under a subscription can change during the period, because Creators add and withdraw Content. We do not promise that a specific piece of Content stays available.
11. When a Subscription Period Ends
A Community Membership and a Creator subscription each run for a fixed period, bought and paid for up front. They do not renew automatically.
- Your access runs to the end of the period you paid for. You keep it for the whole period.
- We tell you before the period ends, so you can decide whether to buy another one.
- At the end of the period, access simply stops. Nothing is charged, because there is no stored payment method and no stored balance to draw on.
- You can buy another period whenever you like, at the price then displayed. There is no penalty for letting a period lapse and no obligation to continue.
Because nothing is charged automatically, there is nothing to fail, nothing to retry and no arrears. You are never billed for a period you did not choose to buy.
12. Refunds, Credits & Irreversibility
12.1 The first remedy is to fix your access
Cryptocurrency payments are irreversible and there is no payment method to reverse to. So where something goes wrong with a purchase, our first remedy is to put the access right — by restoring it, extending it, or granting it again. That is usually the fastest and most useful outcome, and we can do it straight away.
12.2 On-chain refunds
Where putting your access right is not an adequate remedy, or where the Australian Consumer Law entitles you to money rather than a repair, we make an on-chain refund — sending cryptocurrency back to a wallet. Outside those cases an on-chain refund is at our discretion. The mechanics are set out in clause 12.2 of the Refund & Cancellation Policy, which governs.
12.3 What we do not have
There is no chargeback process on the Services, no representment, no issuing bank and no reversal to an original payment method. Nothing in this Section limits your rights in Section 18.
12.4 How to ask
Contact billing@flowerpuss.global. We acknowledge billing and dispute enquiries within 2 business days and aim to resolve them within 10 business days. Full detail, including when a credit is given and when a purchase cannot be reversed, is in the Refund & Cancellation Policy.
13. Acceptable Use & Prohibited Content
Your use of the Services is governed by our Acceptable Use Policy and Content & Community Guidelines, which form part of these Terms. In summary, you must not:
- use the Services if you are under 18, or help anyone under 18 to reach them;
- use the Services if Section 3.2 says you cannot, or take steps to disguise your country or citizenship;
- upload, distribute or solicit unlawful, abusive, non-consensual or infringing material;
- harass, threaten, dox, stalk or abuse any person;
- attempt fraud, hacking, scraping or interference with the Services;
- circumvent age-gating, paywalls, security or content-protection measures; or
- infringe the privacy, publicity or intellectual-property rights of others.
13.1 Absolutely prohibited Content
The following are prohibited without exception. There is no permitted version of any of them.
- Child sexual abuse material
- Incest
- Bestiality
- Rape, or any other non-consensual sexual behaviour
- Non-consensual mutilation of a person or a body part
These prohibitions apply regardless of medium. They extend to photographs, video, computer-generated imagery, cartoons, animation, simulation and AI-generated material.
Nothing on the Services may depict or present non-consent, including simulated or roleplayed non-consent. Kink and roleplay are permitted only where every participant is a consenting adult and the material never mimics non-consent, a minor, or unlawful activity.
14. Content & Licences
Your Content. As between you and Flower Puss, you keep ownership of Content you lawfully create and upload. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and delivery, distribute and display that Content, only as needed to operate, promote and secure the Services and to comply with the law.
Your promises. You promise that you own or hold all necessary rights and documented consents for everything you upload, that every identifiable person depicted is an adult who has consented, and that the Content complies with these Terms and the law.
Using Content as a Member. Content you access is licensed for your personal viewing only. Do not copy, record, screenshot for redistribution, resell or publicly display Content without the rights holder’s written permission. Doing so may end your account and may expose you to legal action by the rights holder.
15. Creators
If you publish or monetise Content, you are a Creator and the Creator Agreement also applies to you. It governs the commercial relationship in full. In outline:
- You supply Flower Puss. You are not a seller to Members, and you do not contract with them.
- You receive a Revenue Share of net revenue attributable to your Content — gross less applicable GST, less processing costs, less refunds and credits. The current rate is published in your Creator account.
- Community Membership revenue is not Content revenue. It is a Member’s access to the platform itself, sold by Flower Puss, and Flower Puss retains it in full.
- Earnings are subject to a holding period before they can be withdrawn — a standard period, and a longer one for new accounts or where a risk flag or a recent dispute exists. Funds are visible during the hold but not withdrawable. The hold is ours, not a provider’s.
- Payouts run in scheduled batches on a published schedule, not on demand. We may review or delay a payout before it executes.
- You bear the on-chain network fees on your payout. Payout routes vary by country, and non-Australian Creators may have limited routes available.
- A refund or credit that lands after your earnings have been released may take your balance negative. We recover the shortfall from your future earnings, and below a stated threshold we write it off.
- You must complete Creator identity verification under Section 4.2, and keep your identity, age, tax and payout details accurate and current, including an ABN where one applies to you.
- You must keep age and consent records for every identifiable person in your Content and produce them on request.
16. Moderation & Enforcement
We use a combination of automated flagging and human review to keep the Services lawful and safe. We may review, remove, blur, age-gate, demonetise or restrict any Content, and suspend or terminate any account, as described in the Acceptable Use Policy. We are not obliged to pre-screen everything.
Reports of child sexual abuse material, suspected minors, non-consensual intimate imagery, or other unlawful activity are treated as the highest priority and actioned without delay. Where the law requires it, we preserve the material and disclose it to the relevant authority.
You can appeal an enforcement decision by writing to support@flowerpuss.global. Appeals are reviewed by our Trust, Safety & Compliance function.
17. Intellectual Property
The Flower Puss name and logo, and all platform software, design and branding, belong to Flower Puss Pty Ltd or its licensors. Apart from the limited licence in Section 6, nothing in these Terms transfers any intellectual-property right to you.
We act on valid copyright takedown notices and we remove repeat infringers. Send notices to support@flowerpuss.global with enough detail to identify the work and the material complained of.
18. Your Australian Consumer Law Rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
If a service we supply fails to meet a consumer guarantee, you are entitled to the remedies the Australian Consumer Law gives you. Where the failure is major, that includes cancelling the service and obtaining a refund of any unused part, and compensation for reasonably foreseeable loss or damage. Where it is not major, we may choose to fix the problem within a reasonable time.
Where we owe you money under this Section, we will pay it. We may offer to put your access right under Section 12, but you do not have to accept a service remedy in place of a remedy the Australian Consumer Law entitles you to.
19. Disclaimers & Liability
This Section applies subject to Section 18 and does not limit anything in it.
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not promise that they will be uninterrupted, error-free or completely secure, and we do not control the availability of the blockchain networks, wallets or third-party providers that payments depend on.
Where our liability can lawfully be limited, it is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of profits, or loss of data, or for the conduct of Creators, Members or third parties. We are not liable for cryptocurrency you send to the wrong address, on the wrong network, or in an asset we do not accept, as described in Section 9.1.
You indemnify us against loss we suffer arising from your breach of these Terms, your Content, or your unlawful use of the Services. This does not apply to the extent the loss was caused by us.
20. Suspension, Termination & Closing Your Account
You may stop using the Services and close your account at any time. Closing your account ends your access at the end of any period you have already paid for.
We may suspend or terminate your access if you breach these Terms or an incorporated policy, if you are or become ineligible under Section 3, if we reasonably suspect fraud, sanctions exposure or money laundering, or where we must act to protect the safety and integrity of the Services or to comply with the law. Where it is reasonable and lawful to do so, we tell you why.
On termination for breach, we may withhold or recover amounts already released to a Creator, as set out in the Creator Agreement.
We keep financial records for 7 years, as the Corporations Act 2001 (Cth) requires, and we keep compliance records for the periods set out in our Privacy Policy. Closing your account does not delete those records.
Sections that should survive termination do survive it, including Sections 12, 14 (for Content already distributed), 17, 18, 19, 21 and 22.
21. Complaints & Disputes
Come to us first. We would rather fix it than argue about it.

22. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
Where a term of this agreement conflicts with a right or remedy you have that cannot lawfully be excluded, that right or remedy prevails to the extent of the inconsistency, and the rest of these Terms continues to apply.
23. Changes & Contact
We may update these Terms to reflect a change in the law, in regulation, or in how the Services work — including when a new payment method goes live. We notify material changes before they take effect. Continuing to use the Services after an update means you accept it. Every version carries a version number, an effective date and a last-updated date, so you can see what changed and when.
